I recently requested a custom skin (theme) from a designer- I was having a hard time getting him to understand what it was I was searching for so I gave him a link to a site that has the color scheme I was looking for- well the designer flat out told me he was not a "ripper" and that he could not do the theme for me. I don't understand what I did wrong.
If he can't or won't copy an idea and does not possess the ability to vision the style yet make it unique, you need a different designer.
This is nothing ethically wrong with duplicating a style so long as you do not "copy" it.
Case in point... Soon after ask.com added the dialog the predicts what you want to type in the search bar, yahoo! added the same thing. It's so the same, I got confused which site I was on one day.
Get a better designer. Sorry if he disagrees with me. But that's life in the big city. Mattel makes a doll that is successful, the other guys copy it. It's called competition if done correctly.
You can always make a post in the marketplace here, for a style, or I would suggest posting at sitepoint, there are several styles sold every day at SP.
I just went to this site:Mega Codez - Powered by vBulletin and I clicked the skin styles logo at the bottom of the page, instead of taking me to the site of graphix labs a white page showed up and flashed really quickly and then I went to another page- is this something fishy?
